I live in Faridabad, Haryana. In my building the entirety of each floor belongs to a separate owner. I live on the 2nd floor. There’s no one above me. My 1st floor neighbor, owing to longstanding animosity, lodged a false complaint against us, alleging that my father abused his wife while going down the common staircase.

Our neighbor had threatened us in the past, so two years ago I had installed CCTV cameras above my door and on my rooftop.

Can CCTV cameras be installed on other sections of the common staircase, without compromising anyone’s privacy, so that we can refute his future false allegations? I am okay with making it accessible to the other two residents.

Common areas in a housing complex serve collective purposes for all residents and installing CCTV cameras in these areas, such as staircases and main entrance, enhances security without compromising individual privacy. Residents can install cameras near their main door gates with consent from others. If a resident raises objections, individual protests do not supersede collective safety concerns. Legal action against unruly neighbors includes serving strong legal notices or collectively lodging complaints for public nuisance at local police stations, or filing suits under relevant legal provisions if necessary.

A.Dear Client,
Common areas in a housing complex are usable for common purposes by all the residents of the building. Installation of CCTV in common areas for security purposes does not in any way invade the privacy of inside parts of individual flats. An individual resident can install a CCTV Camera near the main door gate for security reasons. Without invading the privacy of other residents and upon receipt of the consent of other residents, CCTV cameras may be installed in the common staircase areas for safety and security reasons. A standalone protest or complaint of a resident affecting common interest and safety does not hold good even if he or she litigated her/his objection or complaint before the Court or other authorities. In case of any nuisance from your errant and unruly neighbor, serving a strong legal notice, lodge a complaint against him or her for the commission of public nuisance collectively at the local police station, failing which file a suit for the same cause of action under Sec.268 of IPC before the court of Magistrate concerned. Hope the matter stands resolved peacefully and amicably.

A.Dear sir,
You may approach High court summary and immediate relief in respect of alleged criminal case. You may also get an order against your neighbor to remove such CCTV which is installed above your door.
