Hi I'm 20 Female. My parents don't let me go outside I have no freedom. I want to move out and have no contact with my parents. My parents are abusive. I went to local police station with handwritten letter stating that I'm an adult female and I want to move out/run away without permission of my parents. The police said females even tho adult need permission of parents to move out/run away. Police threatened to call my father to police station. I begged them not to call. Police said if I runaway they will file missing persons FIR and bring me back to my parents. So how can I lawfully move out without parents permission ?

A.Dear Client,
If you are economically stable and able to lead your life independently then you can move out of the house. You cannot compel your parents to maintain you after moving out. However, no one can force you to stay in an abusive household. It would be difficult, if you move out of the house without informing your parents. Instead, in case of abuse by your parents, you can file a complaint to local police under Section 12 of the Protection of Women against Domestic Violence Act, 2005, or lodge a complaint online to the respective state NHRC. If required, you can consult a counselor or an advocate for advice on this matter.

A.Dear Madam,
If you have financial support and moral support then you can stay in any woman PG Centre and thereafter send a legal notice to your parents that you are not interested to reside in their house for various reasons. Further, you may send intimation to the concerned Police Station saying that you are voluntarily staying in PG Centre as such complaint if any if filed by your parents should not be entertained.

A.Dear Client,
When you are experiencing such type of toxic and abusive behaviour from your own parents, you can get in touch with a social worker or NGO who renders dedicated service to help you out of the crisis. This type of attitude is almost common among homes across the country hence it is not an isolated incidence. If you are economically dependent on your family you may not have any choice other than to remain in the same house and continue with the same ordeal. If you feel you can manage outside without the support of your family for all your needs, nothing prevents or restricts you from walking out of your home to look for the destiny of your choice. You cannot legally compel your father/family to maintain you as you are an adult. Therefore, you need to arrange for an independent source of income to live your life on your own terms. In the given situation, moving out or running away from home without informing your biological parents cannot be a solution, instead that puts you in trouble and worse the situation, once parents make a complaint of missing at the police station. Instead, you have the right to file a complaint against your family if they subject you to domestic violence or hurt you mentally with abusive language in the local police station under Sec.12 of the PWDV Act, 2005. Apart from this, you can make a complaint online (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) to the Chairperson, the National Human Rights Commission, New Delhi and the State Human Rights Commission along with the Chairperson, National Commission for Women and State Commission for Women who are empowered to investigate complaints related to domestic violence or atrocities faced by women by sending an email to [email protected] or filing an online complaint on their official website. Further, you can also seek help from the NGOs who rendered dedicated service to the women in distress. You can also opt for counselling from a family counsellor to resolve the issue in-house.
