A.dear client in your case Without Nomination, will or Succession no person will get the two account & property. Your mother can file suit for succession or civil suit before designated Court. It is better to consult a property lawyer to solve the issues amicably quickly.

A.This matter has all the symptoms of not getting solved without any one of you going to Court. There is no way all of it going to your mom without your brother consenting. Try to bring in elders for a amicable solution before filing for partition.

A.since your father died intestate you all are having equal shares to the property and money. File a Partition suit before the court and claim your share.

A.Dear Client, Your late father's property can not be only on your brother's name while you, your sister and your mother is alive. All four of you have your individual shares in that property because there is no will. So you need to prepare a Partition Deed for it. After that you and your sister could give away your share of the property to your mother.
