Cbi registered a case under sec 120 b read with 7 and 13 of corruption act.... after investigation they filed closure report..cbi court didn't accept it..court directed cbi for further investigation under 173(8) against some serving govt officers and took cognizance of offence against private persons and one retired govt servant...the retired persons and private person approached Delhi hc and the hin'bke hc quashed the cognizance stating that the trial court should have ordered for further investigation rather than taking cognizance which is bad in law...now the dept has issued sanction for prosecution against serving officers...cbi stated that they haven't done any investigation and there no further evidence against officers...what will happen to serving officers now? Will the trial court proceed against them as the prosecution sanction been obtained..when cbi saying they haven't did any investigation and abide by their closure report...or does the cbi file chargesheet based on same evidence earlier they filed closure report?
