My wife filed false complaint against me in March 2020 . Her written complaint was registered as NCR with IPC 323, though it contained many false allegations such as beating, using filthy language by husband, false allegations of husband not a govt Officer,etc . Sister of my wife is ACP , so she is using her influence at concerned police station. Husband also filed written complaint against wife on same day by mentioning wife beaten husband and materialistic demands by wife and her parents like flat, car etc . After 09 months, husband filed RTI Application regarding what happened to written complaint of husband. Police station replied that , as husband made written complaint on same day, complaint Application is filed.(means complaint of husband not filed as NCR ). Thereafter, husband wrote written complaint against concerned police station and against her ACP sister to DCP . However as DCP came to know that sister of wife is ACP , then DCP told senior pi in front of husband that sections 509 and 476 should be lodged against husband by reopening the NCR of wife, though domestic violence notice has been received by husband from court. Is it possible for DCP or police station to add another cognisable section 509, 476 of IPC into NCR of wife having single section of 323. Please guide urgently and please advise what I have to do in such difficult circumstances as DCP is also against husband.

A.Hi,
If you feel that there is unfair means being used then appeal to the higher officials. If no resolve is received then you can directly approach the magistrate about the measurements taken by the police.

A.Hi,
If you feel that there is unfair means being used then appeal to the higher officials. If no resolve is received then you can directly approach the magistrate about the measurements taken by the police.

A.You can approach to the high court by filing mandamus writ petition for the behaviour of police and for a fair investigation.
the order from the high court building of neatly put pressure on the police to investigate the matter properly in case you do not found guilty then it will end the harassment from the police.

A.so you are saying DCP doesnt know anything ?
what police can do you can search in arnab goswami case.
you made mistake of taking your wife very lightly.

the only thing is that charge sheet will be weak after adding sections.
