Regarding Mother share in deceased son property

My father got expired in 2013 at the age of 57years without writing will. My father has two younger brothers and a sister who are married. My father and his brothers partitioned my grandfathers property among themselves long back. My father purchased other properties by himself. Post my father death does my grand mother has any share in the property earned by my father??

A.Section 10, Hindu Succession Act deals with the distribution of the property of the propositus, among class I heirs. The rules are:
A. Sons, daughters and the mother of the propositus each take one share.
For example:-
If ‘P’ dies leaving behind his Mother ‘M’, two sons S1 and S2 and two
Daughters D1 and D2, each of the above heirs will take one share, i.e., 1/5th
-‘M’ will take 1/5th ;
- D1 and D2 each will also take 1/5th &
- S1 and S2 each will take one fifth.
Class I heirs:-
The property of a Hindu Male dying intestate would be given first to heirs within Class I. They are:
i. Mother,
ii. Widow,
iii. Daughter,
iv. Son,

A.your grand mother has right to share in the self acquired properties earned by your father and that to without executing any will. If your father executes any will as per the directions of your father in the will properties will be conveyed. For inherited properties notional partition will takes place. That is to say if the property is 100 parts inherited from partition then he will be allotted a share apart from your shares, in that share only your grand mother, your mother and all of you will get a share. You must state all particulars like how many members your family consists of and property particulars etc., then you will get expert advice.
