Respected to Sir /mam,

Can an application under domestic violence act,be filed in J&K with respect to the incident occurred outside the state of J&K?
The Protection of Women from Domestic Violence Act 2005 Central.
The act does not extend to J&K, which has its own laws, the Jammu and Kashmir Protection of Women from Domestic Violence Act 2010.

Actually matter is that I'm suffering a fake case due to mentally physically financially harrasment from my wife and there family. They want extrotion of money. Those are not belong to J&K Permanent Resident.

Already Judicial magistrate first class Disposed-Dismmised of the her case.
Now they will appeal in session court. In KASHMIR valley.

Issue arise State Haryana Sir. But she filed case in KASHMIR DV Act, 2010 first class judicial magistrate dismissed-disposed off case. Now she is in Appeal in session court.

Main Kabhi Bhi KASHMIR me Uske Sath Nahi Raha Hu. Usne Sara matter Mere Ghar State Haryana Ka dikhaya hai Application me. Islie JM First class ne uska Application dismissed-disposed off Kar Diya. Or order pass Kiya ki, Ye matter Jo huwa hai State Haryana me or waha Par Central DV act,2005 hai. Or ye pure India me eligible hai pr I&K me nhi. Or Application Jo filed Kiya tha DV act,2010 J&K ye Haryana me eligible nhi hai. Islie Application lacks of jurisdiction k Karan Dismissed-disposed off Kiya Jata hai.

Phir un logo ne same case ko Criminal Appeal Kar Diya Session court me. Next coming 10/12/18 ko Session court order pass Karega. Ki Appeal accepted hai ya Nahi..

Aap mujhe bataye ki J&K DV Act, 2010 mujh pr eligible Hoga. Mai Haryana se Hu. Or un logo ne jhootha case J&K DV Act se filed Kiya hai.. please help me sir...

A.Dear sir /mam Jammu and Kashmir Protection of Women from Domestic Violence Act 2010. U can not file case any other states. If u not reside in Jammu Kashmir then you can file case where u reside currently

Respected Sir,
Actually matter is that, I am facing fake DV Act, case. She is belongs to state Bihar, Presently living in KASHMIR valley. Our marriage ceremony held in Delhi. She filed a DV act 2010 J&K. All the matter is her Application shown state of Haryana where my home.

I was never stay with her at KASHMIR.
First class judicial magistrate dismissed-disposed off the case. Due to lacks of jurisdiction. And also said that in state where the action arise where DV act, 2005 central which is extend all over India except J&K.

Now they are going to Criminal Appeal for the same case..

My question is can her Appeal accepted..
Please help me sir.
