Corpus fund related querry for redevelopment of society

Initially our developer was going to redevolp our society under section 33(7) using 2.70 fsi 12 floors society but after demolishing the society now he wants to develop it under section 33(12)B using 4.05 fsi, in our development agreement we have mentioned that in future if builder gets extra fsi to develop the society then in such case he will compensate society as per ready recknor rate for such additional fsi availed, but our developer is not giving us the benefits of such additional fsi used by him as he says that he is not bound to obey this clause in development agreement as he is not constructing society under section 33(7), Please guide me whether developer is right or not.
