Dear Sir, I am working as a Assistant Manager in MAS Akshaya Sportswear (Special Economic Zone Unit), its Srilankan Based company, my total experience in this company is 6 years, Now company want close as per their internal issues, Now they are telling that they will give operators 3 month salaries as per the law, but not give it to executive and above level, they are telling this is the law, you people are not come under Industrial act 1947 company was register under the industrial act 1947, when the 500 operators & team leaders are getting the 3 months notice period salary, why the 20 executive and above people are not get. please give you suggestions and how to approach legally.

A.They are also bound to pay the such benefit to others as well you, subject to the agreement clauses in the appointment letter of you and others between the Company authorities.

A.Dear Sir,
You have two options. One to file a representation before the labor commissioner and second is to file a writ petition. Better to fight collectively failing which you may not get justice. Under section 12 of ID Act the Commissioner has full powers.

A.You can approach to labour court at your jurisdiction. You have completed 5 years in that company hence you can also right to claim graduaty as per the law and you will get the same.

A.Dear Sir,
You will be governed by the Agreement you had with the company while got in to the job.
In case of difficulty get in to the Labour Rights of the Employees of the Free Trade Zones/ Special Economic Zones/Export Processing Zones.

They are following the govt rules when they are talking about the workman. But when they are coming to executive and managerial team, they want to give one month notice period or one month salary. Bcz in appointment letter only one way they written. I.e if employee regine the job we need to give 3months notice period. If company remove means it's not mentioned any thing. We are working more than five years we don't have any right to talk to them. Any good points are there to argue with management.
