I live in a co-operative housing on the top floor. Society kids have started running around using it as a playground. This creates a lot of noise and unwanted nuisance in the evenings. Taking this up with society members hasn’t resolved the issue. Although there is a nkda park 2 mins away , they are adamant to use the terrace as a playground. Kindly suggest the best way forward.

A.Dear client, there can be no legal remedy for children using a terrace which is an common area in the society. You have to solve these kind of issue amicably with mutual understanding with the society people and administation.

A.Dear Client,
The rooftops of the Building are also known as an open terrace and a part of the common area useable for all the floor owners of the multistoried building. So, there is no other alternative to resolve issues other than mutual understanding and adjustment between the flat owners for peaceful co-existence. A society cannot raise an objection for use of common area.
