Apartment association members sending false notices

Apartment association had sent a notice stating with 2 rupee interest on not giving the Painting expenses by delaying a month. It leads to defaming us and they are sending notices that further actions will be taken on us by stopping the water, electricity to our flat.

In case of false and malicious legal notices, you can refute it by sending counter legal notice and demand them to stop the false claims and threatens. Further, if the issue escalates, you can also take a legal action by filing a civil suit against the apartment association for the charges of harassment and defamation.

You may get issue legal notice to file defamation cases further they are supposed to recover the same if it is legal by going to the court but not defaming you.

You need to go through the provisions of the Byelaws of the Society that govern the activities of a registered society. You also need to find the minute book or resolution files of the Society. If the Byelaws of the society are silent over the subject, then the executive committee(EC) can pass a resolution on a two-thirds majority of votes in a duly convened meeting for changing fines or penalties on delayed or non-payment of common painting expenses from the resident member. If such a resolution is in place, then the society can ask for fines for late or nonpayment of expenses from the defaulted flat owners. Otherwise, you can bring the matter to the notice of the Registrar or Dy. Registrar of the Cooperative Societies for a resolution in the matter.
