Simplilearn course refund issue
Hi , I have taken data science course from simplilearn for 2 lakhs in loan with the promise of getting live virtual classes and job gurantee from the company but i didn't get half of the classes. I am a working employee so I was not getting enough time to attend classes so i asked for a cohort change but they didn't give me any cohort change. So i raised a complaint asking to change my course atleast but they want me to pay extra for my own course extension which i don't want to pay. Atleast they are not canceling my course so that i don't hv to pay any EMI and they don't have to refund me anything but unfortunately they are not accepting that also. I am in debt because of simplilearn. If i stop paying EMI bank people start torturing me with calls and coming to my work places. So please guide how can i stop pay EMI and get my course worth or refund. I haven't attended single class also. Please advice me on how shall I go forward.
In the current circumstances, it is advisable to obtain a course cancellation certification from the institute. Based on this cancellation certificate, you should promptly notify the relevant Non-Banking Financial Company (NBFC) to cancel the Electronic Clearing Service (ECS) mandate immediately. This step is crucial to halt the recovery of the educational loan and prevent any further accrual of interest on the outstanding loan amount. Additionally, it helps safeguard your Credit Information Bureau India Limited (CIBIL) records from further damage.
If both the institute and the NBFC fail to take appropriate action, it can be considered a deficiency in service and unfair trade practices. In such a situation, you have the option to file a complaint before the Consumer Court against both the institute and the NBFC. The complaint should address the deficiency in service, seek compensation for harassment, and request a refund of tuition fees. It's important to note that the complaint must be filed within two years from the date of the cause of action, which is the date of the refusal of the refund of fees and the stoppage of the Equated Monthly Installment (EMI) against the education loan.
In the prevailing situation, you need to obtain a course cancellation certification from the institute, and based on said cancellation certificate you need to inform the concerned NBFC to cancel the ECS mandate immediately to stop the recovery of the educational loan by repaying the outstanding amount of the loan to save cumulative interest on the loan and to keep your CIBIL records protected from further damage. In case the institute and the NBFC do not take any action on their part that will be treated as a deficiency in service and unfair trade practices and in that situation you may file a complaint before the Consumer Court against both the institute and the NBFC for deficiency in service claiming compensation for harassment and refund of tuition fees. The complaint must be filed within two years from the date of cause of action, i.e. date of refusal of refund of fees and stoppage of EMI against education loan.
